Cofounder and partner at Bechtel & Santo in Grand Junction, Colorado since 1994, Michael’s practice focuses on defending companies in employment litigation, including discrimination lawsuits; wrongful discharge; and wage and hour matters. Through day-to-day counseling, Michael advises employers on areas such as hiring, discipline, termination decisions, leave and disability issues, and on preparing and revising employee handbooks. By helping Colorado companies, large and small, develop sound personnel policies, Michael ensures their risk of employment-related litigation is significantly minimized.

Christina Harney graduated summa cum laude from Arizona State University before earning her law degree from Gonzaga University School of Law, where she served on Law Review. She began her legal career in bankruptcy law before spending six years in healthcare leadership, where she developed expertise in employee benefits, compensation, employment law, and healthcare law. Christina returned to practicing law as a general litigator and has extensive experience in employment disputes, contract matters, and administrative proceedings, including matters before the EEOC and DOL. She is licensed to practice law in Arizona and Colorado.

Keely McCabe

Keely McCabe completed her undergraduate education at Hanover College before earning her law degree from Florida Coastal School of Law. She began her career conducting unemployment insurance appeals hearings for the Indiana Department of Workforce Development before moving to Colorado, where she conducted driver, business licensure, and rule promulgation hearings for the Colorado Department of Revenue. Keely later served as an Administrative Law Judge for the Colorado State Personnel Board, handling employment-related matters, facilitating settlement discussions, and preparing recommendations for the Board.

This annual update will include recent and potential changes to Federal and Colorado law, including a number of bills in the Colorado legislature that concern wage and hour issues, temperatures in the workplace, union elections, FAMLI leave, etc. This talk will also keep you apprised of recent developments in Federal and Colorado case law and inform you of potential changes to employment and labor law that we might see in 2026 and beyond. For example, it will discuss the recent reclassification of marijuana and how that could require employers to accommodate such usage.

Employers frequently face issues with their employees’ illness(es), disability/disabilities, accommodation(s) request(s), leaves, etc. This presentation will discuss critical steps organizations should undertake to manage accommodation and leave request(s) from employees, including understanding how to evaluate essential job functions and accommodation requests and avoiding common missteps that can lead to potential liability. This presentation will also explore practical scenarios that balance compliance, inclusion, and operational needs — helping you protect employee rights while reducing organizational risk.
